If an encroachment is identified, we are dedicated to working with property owners to find solutions.

New technology has helped us better map our rights of way and potential encroachments, identifying potential hazards on properties.

What types of structures and objects are considered restricted encroachments?
Restricted encroachments include, but are not limited to, houses, decks, buildings, barns, sheds, swimming pools, playground equipment, trampolines, fuel tanks, septic tanks, solar panels, motor homes and vehicles. These unapproved encroachments may create unsafe conditions and pose a danger due to high-voltage power flowing through adjacent lines.

What are some approved, safe uses for rights of way?
Lawns, gardens and recreational trails are among the approved, safe uses for rights of way and do not require written consent. These areas are safer as people are not spending significant time in a single location. Other structures and uses will require written agreements with the company.

Removing or relocating encroachments, including pools, sheds, patios and other structures, helps ensure your safety and the safety of those who may need to perform work on transmission facilities in the future.

What if I find it difficult to move existing structures?
We understand that moving existing structures may pose challenges. We’re committed to working with property owners to find solutions. FirstEnergy has the legal authority to require a property owner to remove structures at their own expense.

Can I get verbal consent to install an encroachment on a right of way?
No, FirstEnergy does not issue verbal consent. All consents will be written agreements.

What should I do if I am purchasing a property with existing encroachments?
Check to see if any portion includes FirstEnergy rights of way, if that land has an existing encroachment and if a written consent agreement exists. An encroachment agreement will be recorded at your local courthouse and typically shows up during a title search. Your title agency should be able to help determine this.
